This Privacy Policy explains how AceTrakx LLC (“Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with the AceTrakx software platform, including all related features, services, and applications (collectively, the “Platform”).
1. Scope
This Privacy Policy applies to all individuals who access or use the Platform, including Client representatives, Authorized Users, and any other end users. It governs the handling of personal information and other data collected through the Platform. This Policy is incorporated by reference into the Client Service & Platform License Agreement and the End User Terms of Use. By accessing or using the Platform, you consent to the practices described in this Privacy Policy.
2. Information We Collect
2.1 Information You Provide
We may collect information that you or your Client directly provide, including your name, email address, job title, contact details, account login credentials, and any Client Content (such as data, materials, documents, forms, reports, or other information) that you upload, submit, or enter into the Platform.
2.2 Usage and Training Data
We automatically collect information about your activity on the Platform, including login history, training modules accessed, completion records, progress tracking, interaction with Platform features, and other usage metrics.
2.3 Device and Technical Data
We may collect technical information such as your IP address, browser type and version, device type and identifiers, operating system, and other standard web and application usage data collected through cookies, log files, and similar technologies.
3. How We Use Your Information
We use the information we collect to:
- Provide, operate, maintain, and support the Platform;
- Track and report training completion and compliance activities;
- Improve the functionality, performance, and user experience of the Platform;
- Maintain the security and integrity of the Platform;
- Communicate with you regarding your account, updates, or important notices; and
- Fulfill our obligations under the Client Service & Platform License Agreement.
4. Client Control of Data
The Client (your employer or contracting organization) maintains primary control over accounts and data associated with its Authorized Users. The Client may access, review, export, or request deletion of user activity and completion data. If you have questions about your data or wish to exercise any data rights, you should first contact your Client administrator or employer. We will work with the Client to address such requests in accordance with our contractual obligations.
5. Data Sharing
We do not sell personal information. We may share your information in the following limited circumstances:
- With the Client (your employer or contracting organization) as necessary to provide the Platform and fulfill the Client Agreement;
- With trusted service providers, vendors, and subcontractors who perform services on our behalf (such as hosting, analytics, or security services), subject to appropriate confidentiality and data protection obligations;
- When required by law, court order, subpoena, or other legal process, or to protect the rights, property, or safety of the Company, our users, or the public; and
- In connection with a merger, acquisition, or sale of assets, provided the recipient agrees to respect your information in accordance with this Privacy Policy.
6. Data Security
We implement and maintain commercially reasonable administrative, technical, and physical safeguards designed to protect the information we collect against unauthorized access, use, alteration, or disclosure. However, no system can be guaranteed to be completely secure. You acknowledge that we cannot ensure or warrant the absolute security of any information transmitted to or stored on the Platform, and you use the Platform at your own risk.
7. Data Retention
We retain personal information and Client Content for as long as necessary to provide the Services, fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention periods may also be determined by instructions or requirements from the Client. Upon termination of the Client Agreement or at the Client’s direction, we may delete or return data in accordance with our contractual obligations.
8. User Rights
Depending on applicable law, you may have certain rights regarding your personal information, such as the right to access, correct, or request deletion of your data. Because the Client controls much of the account and usage data, requests to exercise these rights should generally be directed to your employer or Client administrator in the first instance. We will assist the Client in responding to verified requests in accordance with applicable law and our contractual commitments. To submit a request directly to us, please contact the Company using the information provided at the end of this Policy.
9. Third-Party Services
The Platform may contain integrations with or links to third-party services or tools. We are not responsible for the privacy practices, content, or security of those third parties. We encourage you to review the privacy policies of any third-party services you access through the Platform.
10. Children’s Privacy
The Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected information from a child under 18, we will take steps to delete such information promptly.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or applicable law. We will post the revised Privacy Policy on the Platform with an updated Effective Date. Your continued use of the Platform after any changes become effective constitutes your acceptance of the revised Policy. We encourage you to review this Privacy Policy periodically.
